One fatality, multiple injuries in I-95 car accident
A fatal crash recently occurred on Interstate 95 just south of Fort Pierce. At just after half past six in the evening, a pick-up truck traveling north on I-95 in the area of Palm Beach Gardens collided with a sedan that had come to a stop on the side of the throughway. The driver of the truck was killed in the impact and three of the individuals in the sedan suffered minor injuries. A fourth passenger in the sedan sustained serious injuries as a result of the crash.
This tragic story introduces an interesting legal question regarding liability when a potentially responsible party perishes in the car accident they may have caused. Though investigators are still trying to determine why the driver of the pick-up truck slammed into the parked sedan, if the truck driver is found to have caused the accident, the victims in the sedan may not know who they may sue in order to collect their accident-related damages and losses.
In cases such as this where the responsible party has died, victims can often sue the responsible party’s estate in order to collect damages. A person’s estate is the property and wealth that they possessed at the time of their death. When a person claims a legal right to some of that property due to the negligence of the deceased individual, they may be able to recover their accident-related losses.
As stated in the present story, investigators are still determining how this accident occurred. Individuals who have suffered losses in auto accidents and crashes are encouraged to discuss their cases with personal injury lawyers who can help them understand their legal rights.
